President Says "People Shouldn't Be Going Bankrupt Because They Get Sick"

That is a special statement to make but we haven't seen much in the way of helping those who need the help most and not certainly not represented aggressively in the Presidents Inner Circle. It is true, that a significant number of Chapter 7 Bankruptcies occur because of Illness and especially with those over 50. On the surface, this seems to be a simple matter but we can assure you it isn't a simple matter.

When does one find out that you are over your head during an expensive illness? When you walk in or carried into the hospital? Do they hand you a copy of their Price List? Do you know of any hospital that will give you a copy of their Price List? The FTC goes to great lengths to make sure that most things are marked clearly with a price. But, what about medical care- Hospitals, Doctors, etc etc...........the Medical Field seems to be exempt from these controls............so, we ask, when do you know that you can no longer afford to live like a respectable person but have just gone into debt to the point that only filing for Bankruptcy will cure your financial health condition? The Hospital most likely will know and have you coded as probable much sooner then you will have any idea.

So, what does the President mean? Is he going to help? If so, in Simple Terms, how? We will be happy to report as soon as we see a sign. A good start might be getting the Top Executives of AARP involved in advising the President's top people on the pressing needs of those over 50 begging the question, why are those receiving Social Security not receiving a Cost of Living increase this year? That would be a sign that the Administration is committed to helping those who need it. The Social Security recipients is a group that can least afford to not receive a Cost of Living increase. In a time when this country is in financial trouble but is still very generous to other countries, we think it is time to look to our own to make sure they are taken care of? We have people in this country who are in every bit as much trouble as those we see the Stars reaching out to in Africa and else where. Any idea how much this country give to countries in Africa? Might be interesting to know but let's take care of our own first. Or, are we hearing hollow words from the President?

We encourage you to keep informed and we think that AARP is your best and to be trusted source for those over 50 years of age. Inaddition, write and call your Representatives in Washington. Don't stay silent, don't let them stay silent either. The Post Office is still delivering Mail and you can Call them, you don't have to use Email, FaceBook, MySpace, Tweeter, YouTube or another Social Networking groups to stay in touch and make your voice heard. The President and his staff would make you think you do but you really don't.

Check Your Credit Reports Once A Year Free

Check the FTC.gov site ( www.ftc.gov) regarding information on Free Credit Reports. There are sites that sound like you get a free credit report but they have a payment aspect. The one site that you do get you Credit Reports for free once a year, from the three major reporting companies, is www.annualcreditreport.com . This site was set up by the three reporting companies for the convenience of the consumer and it is free. This provides you various protections including helping with Identity Theft. One of the best services for helping with prevention of Identity Theft is www.lifelock.com . Check it out carefully to make sure it is going to meet your needs. Since your Attorney is the only person that is really going to help you in this situation you want one that is: Re-assuring, Non-judgemental, Communicative and Freely Available for questions. This doesn't sound like much but when it comes to helping protect what you will have left of your Estate you want someone who meets the aforementioned attributes. So, interview several before you select one. Have a second meeting with the one you are seriously considering and see if they checkout the sameway they did during the first meeting. This is a very important decision so take your time, don't get pushed into something you are going to regret. Be sure they specialize in Bankruptcy. This Blog is a Public Service effort. Donations are welcome to help keep the information flowing. You are going to find information about the DOJ's rules and regulations more so here then any other place except the DOJ's manuals. We will be giving you the connection to the DOJ's web site with the pages of interest related to how the Department operates and the rules and regulations that the Trustee's operate under. By the way, the case Trustee's are not DOJ employees. They are independent contractors who are appointed by the DOJ through an application process and guessing Who You Know. Just guessing. More about Trustee's on the Web Site www.chapter7usa.com FYI, you don't have to be an Attorney to be a Trustee although many are. You just need extensive business experience. Trustee's are allowed to hire Attorneys to help with a case. All in all, between the Attorneys, Trustee's and the Judges it is a very small world. Everybody knows one another, just like you might know the workers in your office. The Attorney you are working with, they may also be hired by another Trustee to work on another case for a fee. Just makes for a small family of Professionals handling the Bankruptcy Cases in their Region. You should be aware of this relationship. When it comes time to negotiate something in your Estate you hope that your Attorney knows your Trustee very well.

Selecting An Attorney for Chapter 7 Bankruptcy

Here is a start at what to consider when reviewing Attorneys for represent you. This checklist might be a useful guide in the process:


1. Interview more than one Attorney. You should ask about the cases they have represented, how long they have been practicing Bankruptcy Law, what is the price they are going to charge for handling your case (note - court fees are standard, they should not vary from one attorney to the other.) - the Attorney Fees vary greatly. You could save several thousand dollars just by having multiple Attorneys to choose from. Check with CCCS for recommendations. (see below)


2. The Attorney you select will be the closet thing to a friend that you will have in this process. Conduct the initial interview and then select the ones that you want to conduct a second interview - you should be able to select your Attorney after the second interview. Remember, this is the person you will be spending the most time with during this process. Tell them everything, do not hide anything, give them a complete HONEST picture of your situation. Your case could be thrown out if you are not truthful.


3. Don't be rushed or pushed into a decision. This is the most important decision you are going to make.


4. Ask if your candidates have client references that you can check.


5. The only place that we have for you to ask for recommendations for Attorneys to consider is CCCS. "Consumer Credit Counseling Services of Greater Atlanta", this is a known national company.
